Terms of Service
Introduction
This Membership Agreement (“Agreement”) is between you (the “Member”) and High Achievers Lab C.I.C., a company registered in England and Wales (registration number 13878492), (“High Achievers Lab”, “HAL”, “us”, or “we”). By completing the online joining process on our website and becoming a Member, you accept all terms and conditions in this Agreement, the High Achievers Lab Membership Rules, and the High Achievers Lab Member Health and Safety Agreement. You should only join if you have read and agree to all terms.
Definitions
Membership Rules: Rules governing Member conduct, available at [Membership Rules].
Member Health and Safety Agreement: Health and safety obligations, available at [Health and Safety Agreement].
Membership: Your contractual relationship with HAL, which may include:
Monthly Membership: Recurring monthly payments for ongoing access.
Packages: Single class or block of classes (e.g., 5 or 10 Class Pass) paid in advance.
Membership Amount: The upfront fee for fixed-term memberships.
Promotional Rate: An introductory or discounted rate for a limited period or not, as specified during the joining process.
Starting Your Membership
Joining Process: Memberships are processed online via our partner’s platform (TeamUp). Full pricing and options are available at TeamUp and during the joining process. By completing the process, you agree to this Agreement, the Membership Rules, and the Member Health and Safety Agreement. The joining process is subject to TeamUp’s terms and conditions and that HAL is not liable for any losses caused by TeamUp.
Agreement Start: This Agreement begins when you accept the terms during the online joining process and confirm payment. You agree to pay any applicable Membership Amount or Monthly Membership, subject to any Promotional Rate for a limited period, as displayed before confirming payment.
Compliance: You agree to comply with the Membership Rules and Member Health and Safety Agreement, including proper use of HAL’s facility and equipment. Consult staff if unsure about equipment use. HAL is not liable for injuries caused by incorrect use of equipment or facilities.
Age Requirement: You confirm you are at least 18 years old. Valid proof of age may be requested, and failure to provide it may result in membership termination.
Damage Liability: You are liable for any damage to HAL’s equipment or facility caused by your negligent or improper use.
Personal Information: You agree to update HAL immediately via the online Member Area if your contact or personal details change.
Member Health and Safety
Health Declaration: You confirm the declarations in the Member Health and Safety Agreement, including:
The accuracy of information provided.
Your responsibility to consult a medical professional if you have health concerns before participating.
Your good health and ability to engage in exercise, with immediate notification to HAL if this changes.
HAL's Commitments: HAL will:
Maintain a safe, inclusive environment with a zero-tolerance policy for harassment, discrimination, or misconduct.
Ensure staff and instructors are trained to fitness industry standards.
Respect your training decisions but may intervene if exercise exceeds your reasonable ability.
Keep your health information confidential, except where required by law or for safety.
Assumption of Risk: You acknowledge the inherent risks of injury in HAL sessions or facility use and assume such risks, as detailed in the Member Health and Safety Agreement.
Zero-Tolerance for Misconduct
HAL is committed to a safe, respectful, and supportive environment. Any behaviour that is aggressive, abusive, harassing, discriminatory, threatening, or otherwise compromises member or staff safety, including sexual misconduct, will result in immediate membership termination and potential reporting to authorities.
Members are encouraged to report concerns to HAL staff via email or via our anonymous suggestion box (available at [BOX]). Reports will be handled confidentially and impartially, with no tolerance for retaliation.
Changing Your Membership
Modifications: Some membership types allow changes, subject to fees as outlined on our website.
Freezing/Pausing Monthly Membership:
You may freeze your monthly membership for 1-12 months for the following reasons only:
Pregnancy
Illness or injury (a doctor’s certificate may be required; minimum freeze period is 1 month)
Redundancy (not applicable to 5 or 10 Class Passes or during the initial pre-paid period of Discount Memberships)
Requests must be submitted via email, including any required documentation.
Freezes begin on the date of receipt and cannot be backdated. No refunds will be issued for prior payments.
Monthly Membership resumes on your specified date, with Direct Debit payments restarting. If prices increase during the freeze, the new rate applies upon resumption.
Members may unfreeze their membership early by submitting at least two weeks’ notice via email.
Members may cancel a frozen membership by emailing us at least two weeks before its scheduled restart.
For freezes exceeding 6 weeks, your original monthly membership type may not be guaranteed, and you may be placed on a different monthly membership until a spot is available, with any fee difference credited.
Discounted Monthly Memberships: Changing or terminating a discounted membership (e.g., Promotional Rate) waives the discount, and standard rates apply for new or resumed memberships.
Payment
Recurring Payments: For Monthly Memberships, you agree to maintain a Direct Debit (or recurring international credit card payment for overseas members) for the Monthly Membership Amount, due on the date shown during the joining process and monthly thereafter.
Promotional Rates: If applicable, you agree to pay the Promotional Rate during the introductory period, after which the standard Monthly Membership Amount applies.
Price Changes: HAL may adjust the Monthly Membership Amount with at least 4 weeks’ email notice. You may cancel within this period; otherwise, the new rate applies automatically.
No Refunds for Interruptions: No refunds will be issued for temporary service interruptions, foreseen or unforeseen, including facility closures.
Payment Processing: Payments are processed via a third-party platform (TeamUp). By making a booking, you enter their secure payment system and are subject to their terms. HAL is not liable for damages related to their services.
Ending Your Membership
Member Cancellation: Monthly Memberships can be canceled with at least 7 days’ notice before the next billing date, ending at the end of that billing cycle. Notice within 7 days results in one additional payment, with membership ending the following billing cycle. No refunds are given for unused periods. Member should continue using HAL until the billing cycle ends; otherwise, access ceases immediately at the end of the billing month.
HAL Termination: HAL may terminate your membership if:
You fail to pay any Membership Amount or Monthly Membership Amount when due. A 30-day grace period applies. If payment remains outstanding after the grace period, the trader may give written notice demanding immediate payment of the full outstanding balance. If the balance is not paid within the notice period, the trader may terminate the agreement by further written notice after an additional 15 days).
You breach the Membership Rules or Member Health and Safety Agreement (immediately).
Your membership poses a risk to the health or safety of members or staff (immediately).
In such cases, access to HAL sessions and facilities will cease, and no refunds will be issued for unused periods.
Events Beyond Our Control: If HAL is unable to provide services for more than 30 consecutive days due to causes beyond our control (for example, natural disasters, government actions, epidemics, or forced facility closure), either you or HAL may cancel the membership by providing written notice. No compensation will be payable in such circumstances. Customers holding annual or other fixed-term memberships will be entitled to a pro rata refund for any prepaid fees covering periods after the cancellation date for which services were not delivered.
Booking
Booking Window: Classes can be booked in advance via our platform (TeamUp). You may attend one class per day, plus Open Gym sessions.
Cancellations Window and Late Fees: You may unregister to free a spot for another member; however, cancellations made less than 2 hours before class will count against your membership usage and are not eligible for a refund.
Waitlists: If a class is full, join the waitlist. You’ll be automatically added if a spot opens up to 2 hours before the class. After that, we’ll email all waitlisted members, and the first to respond secures the spot.
Late Arrivals: To ensure a safe and smooth experience for all, please arrive 10 minutes early for classes. Late arrivals may be refused entry at the instructor’s discretion to avoid disrupting the session or compromising safety. If you’re running late, please notify us as soon as possible via thriving@highachieverslab.com or phone number (073686 32284), so we can assist you.
Our Responsibility for Loss or Damage
Liability: HAL is responsible for foreseeable loss or damage caused by our breach of this Agreement or failure to use reasonable care and skill. We are not liable for unforeseeable losses or damages.
Limits:Liability for loss or damage (other than death or personal injury) is limited to a reasonable amount, not exceeding the membership fees paid by the customer in the preceding 12 months, taking into account relevant factors such as our negligence.
Exclusions: We do not exclude liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation. We are not liable for:
Loss or damage to property unless caused by our negligence.
Losses from service changes unless caused by our negligence.
Injuries from failure to consult a medical professional before participating.
Managing Your Permissions and Data
Necessary Communications: HAL will send essential emails and SMS messages about your Membership. You cannot opt out of these required messages because they are necessary to fulfill our contractual obligations. You may opt out of promotional communications, but HAL is not responsible for any loss or inconvenience resulting from missing class-related updates. Essential communications are not marketing or promotional; they pertain solely to the operation and administration of the Membership.
How we use any personal data you give us is set out in our Privacy Policy.
CCTV: For safety, security, and crime prevention, HAL operates 24-hour CCTV at our facility. Footage is captured, processed, and retained per our Privacy and CCTV Policy.
Data Storage: Personal data, including membership details, is securely stored per our Privacy Policy.
Contact: Address queries or concerns via email, quoting the email address we hold for you.
Special Terms for Concessions
Discounts: A 10% discount is available for key workers and low-income members on Monthly Memberships, single classes, and 5/10 Class Passes. Students and key workers must provide valid proof of status (e.g., student ID or employment proof) upon request. Discounts are for personal use only and may be terminated if misused or if eligibility ends.
Media Consent
You consent to HAL using photos, audio, or video recordings of your participation in sessions or at the facility for promotional purposes (e.g., social media, advertisements) without compensation. You may withdraw consent at any time by email.
Additional Services
HAL may offer complimentary services, such as inductions or training reviews, at no additional charge.
Other Clauses
Personal Agreement: Only you, the named Member, may benefit from this Agreement.
Instructor Changes: HAL reserves the right to change instructors, cancel, or postpone classes when circumstances require. Such circumstances include, but are not limited to:
Instructor illness, emergency, or unavailability
Insufficient enrolment for a scheduled class
Safety, facility, or weather-related issues
Administrative or operational reasons beyond HAL’s control
When an instructor change is necessary, HAL will make reasonable efforts to assign a qualified replacement instructor and notify enrolled participants as soon as practicable. If a class is canceled or postponed, HAL will notify enrolled participants promptly and provide options that may include rescheduling the class, transferring enrolment to another session, or issuing a refund in accordance with HAL’s refund policy.
HAL is not liable for indirect losses or expenses arising from instructor changes, cancellations, or postponements. Participants are encouraged to review the full terms and refund policy for details on eligibility, timelines, and procedures.
Belongings left in HAL lockers
HAL may remove or dispose of any belongings that have been left in lockers or on HAL premises for longer than 14 days.
HAL is not responsible for loss, damage, or theft of belongings left in lockers or on HAL premises, except to the extent such loss or damage is directly caused by HAL’s negligence.
Before removing items, HAL will make reasonable efforts to notify the owner when contact information is available. Removed items will be handled in accordance with applicable law.
Any personal data found with belongings will be handled in accordance with HAL’s privacy practices and applicable data protection laws.
Questions or claims regarding removed or damaged belongings should be directed to HAL’s team with proof of ownership.
Access: Access to the gym is permitted only with a valid membership or an active booking. Memberships and bookings are non-transferable and may not be lent to or used by other individuals.
Severability: If any term is invalid, unenforceable, or illegal, the remaining terms remain enforceable.
Changes: HAL may update this Agreement, the Membership Rules, or the Member Health and Safety Agreement to comply with changes in applicable laws or regulatory requirements, or to implement minor technical adjustments or improvements, without prior notice. If HAL proposes changes that would materially alter the services, HAL will provide you with reasonable advance notice and the opportunity to terminate your Membership before those changes take effect. HAL will also send regular email updates to inform Members of any revisions.
Transfer of Agreement: HAL may assign, transfer, or dispose of its rights or obligations under this agreement, in whole or in part, to any person or entity without the Customer’s consent. In a sale of HAL or if a lender takes security over HAL or this agreement, the transferee will assume HAL’s rights and may enforce them as if it were HAL.
If HAL assigns or transfers this agreement:
HAL will use reasonable efforts to promptly notify the Customer in writing of the transferee’s identity and contact details.
The transfer will not, except as expressly allowed here or by law, increase the Customer’s obligations or materially reduce the Customer’s rights.
This clause does not limit the Customer’s right to terminate where termination is expressly allowed by this agreement or by law.
Governing Law: This Agreement is governed by the laws of England and Wales.
Record Keeping: Print or save a copy of this Agreement for your records.
